CAMPGROUND & PROPERTY ACCESS AGREEMENT, LIABILITY WAIVER, ASSUMPTION OF RISK, AND INDEMNIFICATION
Premises: 32905 Myelle Rd, Kingston, IL 60145 (DeKalb County, Illinois)
Released Parties:
MYELLEILLINOIS LLC, THE SCOTT P. MYELLE LIVING TRUST (dated August 8, 2026), Scott Perry Myelle (individually, as Manager, and as Trustee), and their respective members, trustees, beneficiaries, agents, representatives, and successors (collectively, the "Released Parties").
1. Assumption of Inherent Risks
I acknowledge and understand that entering, camping, recreating, and remaining on the rural property located at 32905 Myelle Rd, Kingston, IL 60145 involves inherent dangers and severe hazards. These include, but are not limited to: uneven and unpaved terrain, fallen timber, open fields, wooded acreage, ponds, creeks, water bodies, adverse weather, insect and animal encounters, campfires, open flames, vehicle operations, off-road equipment, and remote conditions where emergency medical response may be delayed. I voluntarily enter the Premises and expressly assume all known and unknown risks of property damage, illness, severe personal injury, or death resulting from my presence and participation in any activity on the Premises.
2. Mandatory Health Insurance & On-Site Medical Decision-Maker Condition of Entry
Access to the Premises is strictly conditioned upon absolute compliance with the following medical and insurance standards:
- Proof of Active Insurance: Every individual entering the Premises must be covered by active, valid health and medical insurance.
- Presence of Authorized Medical Decision-Maker: No person who is covered under someone else's insurance policy—including all minor children, teenage dependents, or wards—will be admitted to the Premises unless the policyholder/legal parent or court-appointed legal guardian who possesses legal authority to make emergency medical decisions is physically present on the Premises.
- Denial of Entry: Any person lacking independent health insurance, or any dependent/minor whose legal medical surrogate/parent is absent, is expressly denied permission to enter or remain on the property.
3. Minor Chaperone & Guest Admission Restrictions (No Teen Invitations)
- No Unaccompanied Minors: No individual under the age of eighteen (18) is permitted on the Premises unless physically accompanied, actively supervised, and signed in by their own parent or legal court-appointed guardian at all times.
- Prohibition on Teen Guest Invitations: Minors and teenagers staying on the property are strictly prohibited from inviting, hosting, or admitting other minors, peers, friends, or guests onto the Premises.
- Immediate Removal of Trespassers: Any minor found on the property without their registered parent or legal guardian on-site will be deemed a trespasser under Illinois law and immediately ejected, and local law enforcement (DeKalb County Sheriff's Office) may be contacted.
4. Zero-Tolerance Underage Drinking & Substance Policy
- Absolute Prohibition: Pursuant to Illinois statutory law (including the Illinois Liquor Control Act, 235 ILCS 5/, and the Drug or Alcohol Impaired Minor Responsibility Act, 740 ILCS 58/), there is an absolute zero-tolerance policy for underage drinking. No person under the legal drinking age of twenty-one (21) shall possess, consume, transport, or be under the influence of alcohol on the Premises under any circumstances.
- Adult Accountability: Adults, parents, and legal guardians present on the Premises are strictly prohibited from furnishing, delivering, permitting, or facilitating the possession or consumption of alcoholic beverages to or by any minor.
- Consequences of Violation: Any violation of this policy results in the immediate and permanent expulsion of the entire camping party from the Premises without refund or recourse, and immediate referral to the DeKalb County Sheriff's Office for criminal prosecution.
5. Release of Liability and Covenant Not to Sue
To the fullest extent permitted by Illinois law, I, on behalf of myself, my minor children, my heirs, executors, administrators, personal representatives, and assigns, do hereby release, waive, forever discharge, and hold harmless the Released Parties (including MYELLEILLINOIS LLC, THE SCOTT P. MYELLE LIVING TRUST, Scott Perry Myelle, and their respective members, trustees, and successors) from any and all claims, demands, actions, liabilities, damages, costs, or causes of action arising out of or related to any loss, damage, illness, bodily injury, or death that may be sustained while in or upon the Premises, whether caused by ordinary negligence of the Released Parties, conditions of the land, equipment, or actions of other visitors. I explicitly covenant and agree that I will not file, initiate, or maintain any lawsuit, legal proceeding, or administrative claim against any of the Released Parties.
6. Indemnification and Defense
I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all liability, loss, damage, judgment, expense, claim, or attorney's fees incurred by them arising out of or resulting from: (1) My presence on the Premises or my failure to follow the rules set forth herein; (2) Any injury, illness, damage, or death caused or contributed to by me or any member of my party; (3) Any claim brought by or on behalf of my minor child or ward; and (4) Any liability resulting from underage alcohol possession or consumption related to my party.
7. Emergency Medical Authorization & Financial Responsibility
In the event of an emergency, acute injury, or sudden illness where immediate treatment is necessary: I consent to the administration of first aid, emergency medical transportation (including ambulance or air medical services), and treatment deemed advisable by licensed healthcare providers. I acknowledge and agree that the Released Parties bear no responsibility or duty to provide rescue, first aid, or medical care. I assume full, sole financial responsibility for any and all costs, charges, and medical expenses incurred on my behalf or on behalf of my accompanying minors/dependents.
8. Governing Law, Jurisdiction, and Severability
This Agreement shall be governed by, construed, and enforced in accordance with the laws of the State of Illinois. Any legal action, suit, or proceeding arising out of or connected with this Agreement or entry upon the Premises must be instituted exclusively in the Circuit Court of the Twenty-Third Judicial Circuit, DeKalb County, Illinois. If any provision or portion of this Agreement is held to be invalid or unenforceable under Illinois law, such clause shall be severed or reformed, and the remaining provisions shall remain in full legal force and effect.
